Challenges of collective labor law in times of Covid-19: obstacle or guarantee of change: a legal and international look at its scope and range of application in Colombia

This paper presents a socio-legal analysis of the international influence that collective labor law has in Colombia in the face of the conditions generated by Covid-19. Through a correlational descriptive study, the challenges faced by this area of law were determined in the face of international provisions and trends that have arisen during the adaptation of all productive and state sectors to the pandemic. It is intended to: 1. Present the development of collective labor law at an international level and its influence on the development of this right in Colombia. 2. Describe the influence that the International Labor Organization has on the evolution of this right in Colombia. 3. Determine the adaptation trends to the change of collective labor law in the world of work in the new interaction scenarios generated by the pandemic. 4. Relate some reflections and challenges of Colombian collective labor law in a world that presents profound transformations in labor terms. The results of the analysis reveal that the collective labor law was born as a consequence of the lack of protection that workers had against employers throughout the historical chain; but that the precedents of international protection have been fundamental for the development of the current normative framework; however, its applicability is facing great changes that will be decisive for its existence or extinction.
