Abstract

In Ecuador, remote hearings have been held gradually and are currently the main form of judicial action, due to the health emergency caused by Covid-19; In this sense, work in this modality was allowed as of May 7, 2020 by resolution No. 045-2020 issued by the plenary session of the Judicial Council. Although these decisions issued by the head of the judicial function are a response to current emergencies, they incur inconsistencies that affect constitutional principles. This research addresses the issue from a qualitative analysis, with a research design where the systemic and documentary method predominates, both from jurisprudence and doctrinal analysis. The results of the research show the application of telematic hearings, these being the research object of this study; These hearings present a clear and medium contradiction with constitutional principles, affecting people who are in a legal process, whether of accusation or defense; This has generated total inequality in the administration of justice due to the inadequate or poor application of constitutional provisions and international conventions. It is concluded that technical guarantees must be given that approximate a better perception of telematic audiences, although they allow for the principle of procedural speed, the possibility of violating the principles of immediacy is evident, the latter implies disadvantages that may affect the criterion of judge in the testimonial assessment, as well as the evidentiary evidence.
